OPEN CALL MODELING CONTEST - SEASON 2

Article 1 - Organization and Purpose of the Contest

The OPEN CALL modeling contest - Season 2 (hereinafter the “Contest”) is organized by TIMMERMAN EXPERTISE, a French simplified single-shareholder joint-stock company (SASU), registered with the Paris Trade and Companies Register under number 938 071 297 (hereinafter the “Organizer”).

The purpose of the Contest is to discover and showcase new profiles in the fields of modeling, image and, depending on the categories, content creation. It includes a paid initial session, artistic and professional evaluations, as well as additional meetings that may be organized by invitation.

OPEN CALL is not a modeling agency and does not act, solely as a result of registration, as the candidate’s employer, recruiter or representative. Participation does not constitute a job offer or a promise of a contract, representation, income or a professional career, subject to the prizes expressly guaranteed to the winner in the appendix to these rules.

The trademarks, logos, texts, graphic elements and content produced for the Contest are protected by intellectual property rules. They belong to TIMMERMAN EXPERTISE or to their respective owners.

Article 2 - Schedule, Territory and Official Communications

Season 2 takes place during the period announced on the website www.open-call.com and in OPEN CALL’s official communications. The date, time and location of each candidate’s initial session are indicated before payment and then confirmed in writing, particularly by email.

The dates of the OPEN CALL REVIEW days and the provisional date on which the result will be announced are published or communicated during the season. The result is announced through an official OPEN CALL channel, and each candidate must ensure that their contact details remain up to date.

Only the website www.open-call.com, email addresses using the open-call.com domain and social media accounts expressly identified by the Organizer are considered official.

Article 3 - Eligibility Requirements

The Contest is open to natural persons, whether adults or minors. Members of TIMMERMAN EXPERTISE, persons directly involved in the organization or in the jury’s decision-making, and persons whose participation would create a clear conflict of interest are excluded.

Any minor candidate must provide, no later than before taking part, a dated authorization signed by their legal representative, together with any requested proof of identity.

The lingerie category is exclusively reserved for adult candidates. No minor may be required to wear an outfit or adopt a pose that is inappropriate for their age.

The candidate, or their legal representative if the candidate is a minor, certifies that the information provided is accurate and that no incompatible contract or commitment prevents their participation. An identity document and, where required by law, additional supporting documents may be requested.

Article 4 - Categories

Candidates may be assigned to one or more categories corresponding to their profile, including:

  • runway model;
  • commercial model;
  • talent, influencer or content creator;
  • curve;
  • small;
  • details;
  • lingerie;
  • senior;
  • junior;
  • atypical.

The Organizer may adapt, combine or supplement the categories according to the profiles received and the needs of the season. Assignment to a category does not constitute a ranking or a guarantee of selection or victory.

Article 5 - Registration and Participation Fees

To participate, the candidate must:

  1. complete the official form or provide the requested information through an official channel;
  2. be contacted by the OPEN CALL team to validate their request and confirm a session date;
  3. read these rules, the Terms and Conditions of Sale and the pre-contractual information;
  4. pay the participation fee in order to definitively confirm their registration.

The participation fee is set at €49 including VAT, except in the case of a promotional offer or specific rate announced before payment. Registration is personal and non-transferable.

This fee exclusively covers the organization and performance of the technical and material services provided during the initial session: reception, walking or runway exercise, photography, presentation recording, measurements and creation of the digital comp card.

Any general observations provided to the candidate regarding their posture or presentation are offered free of charge and on an ancillary basis. No part of the €49 fee pays for advice on opportunities to access the modeling profession, a selection, an invitation, an introduction, a contract or preferential treatment by the jury.

Payment of the fee constitutes acceptance of these rules. No refund will be possible once payment has been made.

Article 6 - Initial Session and Comp Card

Unless otherwise specified to the candidate before payment, the initial session generally takes place as follows:

  • reception of the candidate and full recording of the measurements required to present their profile;
  • a pola-style photo session;
  • recording of a walking video;
  • recording of a pola-style video intended to present the candidate’s profile;
  • recording of a presentation video or short interview;
  • a studio photo session.

The candidate may also be photographed or filmed backstage during the session, while preparing or during an interview. However, these additional recordings are not systematic and depend on the organization of each session.

The purpose of these exercises is to allow the candidate to discover and experience the main stages of a photo shoot, casting or professional presentation. They also allow the OPEN CALL team, the jury and, where applicable, associated professionals to assess the candidate’s profile, photogenic qualities, ease in front of the camera, walk and ability to present themselves.

Items Included and Provided to the Candidate

The only item included in the participation fee and provided to the candidate is a digital comp card, created by OPEN CALL, comprising:

  • four pola-style photographs selected by OPEN CALL;
  • the candidate’s measurements;
  • the layout and information required to present their profile.

The four photographs are incorporated directly into the comp card. They are therefore not provided separately as four individual photographic files.

The selection of the photographs, their cropping, order, any technical corrections and the layout of the comp card are determined by OPEN CALL’s artistic direction.

The provisional delivery time for the comp card is stated in the order confirmation. Unless a specific agreement has been reached or a difficulty has been brought to the candidate’s attention, it will be delivered no later than thirty calendar days after the session.

Items Not Included and Optional Purchases

Unless otherwise stated in writing, the participation fee does not include:

  • photographs taken during the studio session;
  • pola-style photographs as separate files;
  • walking, presentation, interview or pola-style videos;
  • photographs or videos taken backstage;
  • raw files, rushes, unselected photographs and working files.

OPEN CALL may offer the candidate the opportunity to purchase some of these items separately when they are available. The nature of the items offered and their price are communicated to the candidate before any purchase.

These purchases are entirely optional and are not subject to any obligation. Making or refusing an additional purchase has no impact on the candidate’s admission, evaluation, selection, possible invitation to an OPEN CALL REVIEW or the result of the Contest.

An additional purchase does not guarantee any advantage or favorable decision in connection with the Contest.

The photographs, videos, measurements and materials produced during the session may be reviewed by the authorized OPEN CALL team, the jury and associated professionals for the purposes of organizing and evaluating the Contest.

Participation in the initial session does not guarantee an invitation to an OPEN CALL REVIEW, a professional proposal, selection or victory in the Contest.

Article 7 - OPEN CALL REVIEW Days

The provisional schedule for Season 2 includes five OPEN CALL REVIEW days. Their number, date, location, format and the list of professionals attending may be adapted for legitimate organizational reasons, without reducing the services paid for as part of the initial session.

OPEN CALL REVIEWS are additional professional meetings that are free of charge, optional and exclusively accessible by invitation. They are neither a paid stage, nor a mandatory final, nor a condition for remaining a candidate or winning the Contest.

At any time during the season, the OPEN CALL team, the jury or associated professionals may invite candidates whose profiles have attracted their attention. A candidate may receive no invitation, one invitation or invitations to several days.

During these days, agencies, brands, jury members and other professionals may assess candidates, provide them with general observations or, solely on their own initiative, offer them a casting, collaboration, project or representation. OPEN CALL does not guarantee the attendance of any particular professional.

Any proposal made by a third party is independent of the Contest. The candidate remains free to accept or refuse it and must review its terms before committing. For a minor, any commitment is subject to the agreement of the legal representative and the applicable legal formalities.

Refusing an invitation, when communicated within the requested time limit, does not result in exclusion or any penalty and does not prevent the candidate from winning the Contest.

Transport, accommodation, meals and personal expenses remain the candidate’s responsibility.

Article 8 - Jury, Criteria and Selection of the Winner

At the end of the season, the jury selects the winner from among all candidates who have actually completed their initial session and remain eligible. The absence of an invitation to an OPEN CALL REVIEW, or the refusal of an invitation communicated within the requested time limit, cannot in itself reduce the candidate’s chances of winning.

The decision is based on an overall assessment of the candidate’s journey and may take into account, in particular:

  • photographs, videos, measurements and the comp card;
  • artistic and professional potential;
  • photogenic qualities, presence, presentation and ease in front of the camera;
  • walking, posture and suitability for the categories;
  • behavior, punctuality, compliance with instructions and professionalism;
  • the jury’s evaluations and, where applicable, observations collected during an OPEN CALL REVIEW.

Participation in an OPEN CALL REVIEW may provide additional assessment information, but it is neither a prerequisite nor an automatic advantage. The jury assesses the available information consistently using the same criteria.

The jury’s artistic and professional decisions are final. There is no obligation to disclose individual scores.

Article 9 - Winner’s Prizes

The winner of Season 2 receives the following prizes:

  1. A written proposal for a representation contract with an OPEN CALL partner mother agency. The conclusion and effective date of this contract remain subject to verification of the winner’s identity and eligibility, the absence of any incompatible commitment, the agreement of their legal representative if they are a minor, and acceptance of the proposed contractual terms. This prize guarantees that a contract proposal will be provided, but does not guarantee its automatic signature or the subsequent award of professional contracts, assignments or income.
  2. Gifts offered by OPEN CALL’s partners. The nature, quantity and, where applicable, conditions of use of these gifts will be communicated on the website or through another official OPEN CALL channel before the winner is selected. Only gifts expressly announced as part of the Season 2 prizes are guaranteed.
  3. One or more trips or journeys, where they have been expressly announced as part of the Season 2 prizes. The destination, period, duration, services included and any expenses remaining payable by the winner are communicated in writing before the trip or journey is accepted.

Sessions are offered according to the schedule established by OPEN CALL, subject to prior booking and the availability of the studios, photographers and teams. Transport, accommodation, meals, makeup, hairstyling, styling and personal expenses remain the winner’s responsibility.

If a prize becomes permanently unavailable for a reason beyond the Organizer’s control, the Organizer may replace it with a prize of a reasonably equivalent nature and value. Any substantial change will be communicated to the winner in writing. This wording avoids the appendix while distinguishing guaranteed prizes from gifts or trips that only become guaranteed following a specific official announcement.

Article 10 - Additional Products and Services

OPEN CALL may separately and optionally offer additional products or services, including additional photographs, prints, photo sessions, videos, portfolios, technical workshops or layout services.

The content, price, delivery time and other conditions are communicated before each order and are subject to a separate agreement and payment.

No additional product or service pays for advice on opportunities to access the modeling profession. No purchase, or refusal to make a purchase, has any impact on the evaluation, continued participation in the Contest, an invitation to an OPEN CALL REVIEW, the jury’s decisions or proposals made by a professional.

Article 11 - Transparency, Independence and No Guarantee

The registration fee corresponds to objective services. It never constitutes payment for a selection, a place in a final, an invitation, a contract, an introduction, a victory or a professional opportunity.

Jury members, agencies, brands and professionals retain their freedom of assessment. A professional with a direct personal interest that could affect their impartiality may be excluded from evaluating the candidate concerned.

OPEN CALL does not guarantee any contract, income, employment, publication, fame or career.

Article 12 - Photography and Recording, Image Rights, Voice and Use of Content

Participation in the Contest’s initial session and any OPEN CALL REVIEW days involves the creation of photographs, videos and audio recordings necessary for the conduct of the Contest, the creation of the comp card, the evaluation of candidates and the retention of the materials enabling the jury to make its decisions.

The content concerned includes, in particular, pola-style photographs, portraits, runway or staged photographs, presentation videos, interviews, walking exercises, runway shows, spoken contributions, backstage images, group images and, more generally, all photographs, videos and recordings produced during the initial session, an OPEN CALL REVIEW day or any other official Contest activity.

Subject to the candidate’s express authorization obtained by means of a dedicated checkbox, an electronic form or a signed document, the candidate authorizes TIMMERMAN EXPERTISE, operator of the OPEN CALL brand, free of charge, to select and use all or part of this content for the presentation, communication, promotion and advertising of OPEN CALL, the Contest, its different seasons and its events.

This authorization includes the right to reproduce, represent, publish and distribute the candidate’s image, voice, first name, profile and statements on the following media:

  • the OPEN CALL website and official pages;
  • social networks, photo and video sharing platforms and online broadcasting services;
  • OPEN CALL sponsored posts and digital advertising campaigns;
  • newsletters, emails, press kits and press releases;
  • posters, flyers, brochures, catalogs, presentations, invitations and other printed materials;
  • screens, projections, retrospectives, trailers and materials shown at events;
  • presentations sent to agencies, brands, partners, jury members and professionals associated with the Contest.

Media outlets, agencies, brands and partners may also reproduce or reshare OPEN CALL’s official publications solely for the purpose of reporting on or presenting the Contest. Any use of the candidate’s image by a third party for its own advertising campaign, independently of OPEN CALL’s communications, requires separate authorization.

The authorization covers all content created, without any obligation for OPEN CALL to publish it all. OPEN CALL remains free to select the content used, its publication date, its order and the manner in which it is presented. The candidate has no right of prior approval over edits or publications produced in accordance with this article.

For the purposes of this use, OPEN CALL is authorized to make any reasonable technical or editorial adaptation, including framing, cropping, editing, color grading, correction of lighting or sound, and the addition of music, text, subtitles, translations, logos, credits or graphic elements. These adaptations must not distort the candidate’s statements, present the candidate in a misleading manner, or infringe their dignity, reputation, privacy or integrity.

This authorization is granted on a non-exclusive basis, worldwide, for a period of five years from the date on which each item of content is created. It does not give rise to any remuneration, royalty or compensation, as the recordings are produced in connection with the Contest and its communications.

For a minor candidate, authorization is given by their legal representative or representatives. The signing legal representative certifies that they have the necessary authority or the agreement of the other holder of parental authority. The minor is informed and involved in the decision according to their age and level of maturity.

Raw files, rushes, unselected photographs and editing files remain the property of their authors or rights holders and are not provided to the candidate unless otherwise agreed in writing. The candidate retains only the rights of use expressly granted in relation to the polas, photographs or comp cards actually provided to them.

Article 13 - Personal Data

TIMMERMAN EXPERTISE processes the data required to manage applications, payments, invitations, sessions, comp cards, evaluations, OPEN CALL REVIEWS, results, prizes, complaints and legal obligations. The data may include identity, age, contact details, measurements, photographs, videos, voice and, where strictly necessary, identity documents or documents relating to minors.

For the purposes of the Contest, certain profile information may be presented to jury members, agencies, brands and associated professionals. Any transfer in connection with an opportunity outside the Contest that is not necessary for its conduct is based on specific information and, where required, the candidate’s consent.

Data is retained during the season and then, depending on its nature, for the period required to monitor the relationship, provide evidence of rights and manage complaints. Accounting documents are retained for ten years; marketing data is retained for no more than three years from the last contact; image content is retained for the duration of the separate authorization, without exceeding five years for promotional use. Sensitive supporting documents are deleted as soon as they are no longer required, unless there is a legal obligation to retain them.

Article 14 - Commitments, Safety and Exclusion

Each candidate agrees to comply with schedules, invitations, safety instructions, the premises, equipment, other candidates, professionals and team members. Fraud, identity theft, false documents, threats, violence, insults, discriminatory behavior, harassment, intentional damage, endangerment and unauthorized disclosure of confidential information are prohibited in particular.

Depending on the nature and seriousness of the facts, the Organizer may issue a reminder, warning, suspension or exclusion. Except in an emergency related to safety, clear fraud or material impossibility, the candidate is given an opportunity to briefly present their observations before any permanent exclusion.

In the event of exclusion attributable to the candidate, services already performed will not be refunded.

Article 15 - Complaints and Jurisdiction

Any complaint must be sent to contact@open-call.com. It must state the candidate’s name, contact details, date and place of participation, the precise subject of the request and any useful supporting documents.

These rules are governed by French law, subject to any mandatory provisions that may apply to a consumer residing in another country. If no amicable solution or mediation is reached, the dispute will fall within the jurisdiction of the competent courts in accordance with the applicable legal rules.

Article 16 - Modification, Postponement, Interruption or Cancellation

The Organizer may adapt the dates, times, locations, speakers, jury, partners, categories or practical arrangements where such adaptation is justified by an organizational, technical, health or safety reason, an insufficient number of participants, force majeure or an event beyond its control.

An adaptation may not substantially reduce a paid service, a candidate’s essential rights or the value of a guaranteed prize without offering, as appropriate, an equivalent solution, a postponement or the refund provided for in the Terms and Conditions of Sale.

If an initial session is canceled by the Organizer, the candidate may choose between a proposed replacement date and a refund of the amounts paid for the canceled session. The arrangements relating to indirect expenses and force majeure events are set out in the Terms and Conditions of Sale.

The cancellation or postponement of an OPEN CALL REVIEW, which is free and optional, does not give rise to any right to compensation.

Article 17 - Acceptance, Versions and Hierarchy of Documents

Registration and participation imply acceptance of these rules in the version communicated before payment. The rules and the Terms and Conditions of Sale are made available on a durable medium and are sent with the registration confirmation or made accessible through a durable link.

The Terms and Conditions of Sale prevail for matters relating to the formation of the contract, payment, withdrawal, cancellations, refunds, delivery, statutory guarantees, contractual liability and mediation. These rules prevail for the artistic conduct of the Contest, the categories, OPEN CALL REVIEWS, the jury, the criteria and the prizes. The privacy policy specifies the data processing activities. Mandatory legal provisions always prevail.

A subsequent amendment does not apply retroactively to rights already acquired by a candidate, except where required by law or where the amendment is exclusively favorable.
