These Terms and Conditions of Sale (hereinafter the “T&Cs”) govern the contractual relationship between TIMMERMAN EXPERTISE, organizer of the OPEN CALL contest (hereinafter the “Organizer”), and any natural person who registers a candidate for the Contest or orders a product or service offered by the Organizer (hereinafter the “Client” and, when that person takes part in the Contest personally, the “Participant”).
Where the Participant is a minor, the Client is the Participant’s legal representative or the person legally authorized to enter into the contract on the Participant’s behalf. The legal representative undertakes to explain the official rules, these T&Cs and any authorizations that may be requested to the minor in terms appropriate to the minor’s age and maturity.
The T&Cs apply to the registration request, the initial OPEN CALL session, payment of the participation fee and, subject to the specific terms presented before each order, the additional products and services offered by the Organizer.
They supplement the official rules of the OPEN CALL contest - Season 2 (hereinafter the “Rules”). The applicable version is the version communicated to the Client and accepted before payment.

3.1 - Nature of the Contest
OPEN CALL is a contest intended to discover and showcase new profiles in the fields of modeling, image and, depending on the categories, content creation. It includes a paid initial session, artistic and professional assessments, and additional meetings that may be organized free of charge by invitation.
OPEN CALL is not a modeling agency and does not act, solely as a result of registration, as the Participant’s employer, recruiter or agent. Registration constitutes neither a job offer nor a promise of a contract, representation, assignment, income, publication, recognition or professional career, subject to the prizes expressly provided for the winner in Article 9 of the Rules.
3.2 - Usual conduct of the initial session
Unless otherwise specified before payment, the initial session generally includes:
The Participant may also be photographed or filmed backstage, during preparation or during an interview. These additional recordings are not systematic and depend on how the session is organized.
These exercises allow the Participant to discover the main stages of a shoot, casting or professional presentation and provide the OPEN CALL team, the jury and, where applicable, associated professionals with the information required to assess the Participant’s profile.
3.3 - The only material included and delivered to the Participant
The only material included in the participation fee and delivered to the Participant is a digital comp card produced by OPEN CALL, including:
The four photographs are incorporated directly into the comp card. They are not delivered separately as four individual photograph files.
The selection of the photographs, their cropping, order, any technical corrections and the layout are determined by OPEN CALL’s artistic direction.
The estimated delivery time is stated in the order confirmation. Unless otherwise agreed or unless a difficulty is brought to the Client’s attention, the comp card is delivered no later than thirty calendar days after the session.
3.4 - Items not included
Unless otherwise stated in writing, the participation fee does not include:
Some of these items may be offered separately for purchase when available. Any additional purchase is optional, is subject to separate information and payment, and has no effect on admission, assessment, selection, any invitation to an OPEN CALL REVIEW or the outcome of the Contest.
3.5 - No payment for a selection or opportunity
The participation fee pays exclusively for the organization and performance of the technical and material services of the initial session. Any general observations provided regarding posture or presentation are free of charge and ancillary.
No part of the price pays for advice on the possibility of accessing modeling activity, a selection, invitation, introduction, contract, representation, victory or favor from the jury.
4.1 - Application request
The Client completes the official form or provides the requested information through an official OPEN CALL channel. This step constitutes an application request and not a final registration.
Only the website www.open-call.com, email addresses using the open-call.com domain and social media accounts expressly identified by the Organizer are considered official.
4.2 - Validation of the request and prior information
After reviewing the request, the Organizer may contact the Client to verify the information, answer questions and confirm a session date.
Before payment, the Client is informed of the date or period, time, location, total price, included content, main cancellation conditions and applicable withdrawal regime.
4.3 - Acceptance of contractual documents
Before paying, the Client must be able to view and retain these T&Cs, the Rules, the privacy policy and the applicable pre-contractual information. Acceptance of these T&Cs and the Rules is obtained by means of an unticked checkbox or an equivalent process. The privacy policy is brought to the Client’s attention, without its mere consultation constituting consent to processing that requires separate agreement.
The payment validation function clearly states that the order entails an obligation to pay.
4.4 - Conclusion of the contract
The contract is concluded upon receipt of full payment and confirmation thereof by the Organizer. Registration is personal, final and non-transferable, subject to the rights provided for in these T&Cs and by mandatory legal provisions.
4.5 - Confirmation on a durable medium
Confirmation is sent to the Client, in particular by email. It states or provides access to the Organizer’s identity, the price, date or period, time, location, the service ordered and the applicable contractual documents.
The Client must verify the accuracy of the email address, check junk mail folders and promptly report any error in the confirmation information.
4.6 - Updating contact details
The Client and the Participant must keep their contact details up to date throughout the season in order to receive invitations, information relating to any OPEN CALL REVIEW, communications concerning the result and information relating to the prizes.
A call strictly necessary to process an application request initiated by the Client is limited to that request.
From August 11, 2026, any call for commercial prospecting purposes separate from processing the request requires the prior, freely given, specific, informed, unambiguous and revocable consent of the person called, except where a legal exception applies, particularly where the call concerns an ongoing contract within the limits provided by law. This consent is obtained separately from acceptance of these T&Cs.
5.1 - Eligible persons and exclusions
The Contest is open to adult and minor natural persons. Members of TIMMERMAN EXPERTISE, persons directly involved in organizing the Contest or in the jury’s decision, and persons whose participation would create a clear conflict of interest are excluded.
5.2 - Accuracy of information and incompatible commitments
The Client and the Participant warrant that the information provided is accurate, truthful and up to date. They certify that no incompatible contract or commitment prevents participation in the Contest.
Any false identity, forged document, concealment of an incompatible commitment or inaccurate material information may result in refusal of registration or a proportionate measure up to and including exclusion, without prejudice to legal remedies.
5.3 - Minor Participants
Any minor Participant must provide, no later than before taking part, an authorization dated and signed by the legal representative, together with any requested proof of identity.
Where required by law in view of the minor’s age and the exact nature of the activity, the Organizer may request any necessary administrative or medical authorization or additional formality. The session may be postponed or refused until these conditions have been met.
The lingerie category is exclusively reserved for adult Participants. No minor may be required to wear clothing or adopt a pose inappropriate for the minor’s age.
6.1 - Participation fee
The registration price for OPEN CALL is set at 49 euros including all taxes per Participant, unless a promotional offer or specific rate is clearly announced before payment. The applicable price is the price communicated at the time of the order.
Registration is personal and non-transferable.
6.2 - Services covered by the price
The price covers exclusively the organization and performance of the technical and material services described in Article 3, together with the creation and delivery of the digital comp card.
6.3 - Additional products and services
The prices of additional products or services are stated in euros including all taxes before each order. Any delivery charges or other mandatory charges are specified separately before payment.
6.4 - Personal expenses
Transport, accommodation, meals, clothing, hairdressing, makeup, accompanying-person costs, administrative formalities and other personal expenses are not included, unless otherwise agreed in writing by the Organizer.
Payment of the registration fee is made online using the secure link sent after validation of the application request and session date.
The payment methods offered at the time of the order, including bank cards, are processed by Stripe or an equivalent payment service provider. The Organizer does not have access to the full bank card number.
In the event of payment refusal, non-payment, payment cancellation or legitimate suspicion of fraud, registration is not confirmed or may be suspended until the situation has been regularized.
The Client receives confirmation and proof of payment. An invoice is issued where required by regulations or upon request, subject to the provision of the necessary information.
In accordance with Article L.221-28, 12° of the French Consumer Code, the fourteen-day right of withdrawal does not apply to services relating to leisure activities to be provided on a specific date or during a specific period.
The Client expressly acknowledges that participation in the OPEN CALL contest constitutes a service falling within this exception, insofar as it is linked to a session organized on a specific date or during a specific period brought to the Client’s attention before payment.
Consequently, the Client does not benefit from a fourteen-day right of withdrawal for registration in the OPEN CALL contest.
This information is brought to the Client’s attention before payment.
9.1 - Cancellation or inability to attend on the Client’s part
Subject to mandatory legal provisions, applicable guarantees and cases expressly provided for in these T&Cs, validated and paid registration is firm and final.
In the event of inability to attend, absence, withdrawal or renunciation by the Client or the Participant, no refund is due. The Organizer may, as a commercial gesture and without being obliged to do so, offer a postponement to another session, subject to availability and in accordance with the conditions communicated. Such a gesture does not create an acquired right for other requests.
9.2 - Adaptation or modification by the Organizer
The Organizer may adapt the times, locations, speakers, practical arrangements or ancillary content for a legitimate organizational, technical, health or safety reason, because of an insufficient number of participants, force majeure or an event beyond its control, provided that the paid service or the Client’s essential rights are not substantially reduced.
Where a modification substantially affects the date, time, location or content of the initial session, the Organizer offers, as appropriate, an equivalent solution, a postponement or reimbursement of the sums paid for the service concerned.
9.3 - Cancellation of the initial session by the Organizer
In the event that the initial session is cancelled by the Organizer, the Client must propose a replacement date.
9.4 - Delay or absence on the day of the session
A significant delay or absence may make participation in all or part of the session impossible without giving rise to a refund. The Organizer makes its best efforts to accommodate a late Participant where materially possible, without being able to guarantee this.
9.5 - OPEN CALL REVIEW
The cancellation, postponement or modification of an OPEN CALL REVIEW, which is free, optional and separate from the paid services, does not give rise to any refund or compensation.
Each Participant undertakes to comply with schedules, invitations, safety instructions, premises, equipment, other Participants, professionals and team members.
Fraud, identity theft, false documents, threats, violence, insults, discriminatory conduct, harassment, deliberate damage, endangerment, serious disruption of the event and unauthorized disclosure of confidential information are prohibited in particular.
Depending on the nature and seriousness of the facts, the Organizer may issue a reminder of the rules, a warning, a suspension or an exclusion.
Immediate exclusion is possible where necessary for safety, the protection of persons, the prevention of obvious fraud or the continuity of the event. In other cases, the Participant is given the opportunity to briefly present observations before a final exclusion, unless this is materially impossible.
Where exclusion is attributable to the Participant, services already performed are not refunded.
The provisional schedule for Season 2 includes five OPEN CALL REVIEW days. Their number, date, location, format and the list of professionals attending may be adapted for a legitimate organizational reason without reducing the services paid for as part of the initial session.
OPEN CALL REVIEW events are additional professional meetings that are free of charge, optional and accessible exclusively by invitation. They constitute neither a separate paid service, nor a mandatory final, nor a condition for remaining a candidate or winning the Contest.
At any time during the season, the OPEN CALL team, the jury or associated professionals may invite Participants whose profile has attracted their attention. A Participant may receive no invitation, one invitation or invitations to several days.
Refusal of an invitation, when communicated within the requested period, does not result in exclusion or any penalty and does not prevent the Participant from winning the Contest. A Participant who has confirmed attendance is asked to inform the Organizer promptly in the event of an impediment, in order to allow the day to be reorganized.
OPEN CALL does not guarantee the attendance of any particular agency, brand, jury member or professional.
Any casting, collaboration, project or representation proposal made by a third party is independent of the Contest. The Participant remains free to accept or refuse it and must verify the third party’s identity, the scope of the proposal, remuneration, duration, obligations and all other conditions before making a commitment. For a minor, any commitment is subject to the legal representative’s agreement and the applicable legal formalities.
Transport, accommodation, meal and personal expenses connected with an OPEN CALL REVIEW remain the Participant’s responsibility.
OPEN CALL may separately and optionally offer additional products or services, including additional photographs, separate photograph files, prints, printing, photo sessions, videos, portfolios, technical workshops or layout services.
Each purchase is subject to separate information and validation. Before the order, the following are specified in particular:
Purchasing or refusing an additional product or service has no effect on admission, assessment, continued participation in the Contest, invitation to an OPEN CALL REVIEW, jury decisions, the result or proposals from a professional.
Photographs, videos, prints, layouts or other personalized creations are produced in accordance with the agreed elements. Minor differences in cropping, rendering, color or printing resulting from screens, media and technical processes do not necessarily constitute a defect, without depriving the Client of legal guarantees.
13.1 - Delivery of the comp card and digital content
The comp card and other digital products are delivered to the email address provided by the Client, by means of a download link or by any other announced process.
The Client must verify the accuracy of the email address, check junk mail folders and ensure the reasonable compatibility of the Client’s equipment with the announced formats. The Client must report any reception difficulty so that the Organizer can carry out checks and, where possible, resend the material.
13.2 - Tangible goods
Tangible goods are delivered in accordance with the terms, charges and time limits stated before the order. The risk of loss or damage passes to the Client when the Client takes physical possession of the goods, except where otherwise provided by law.
13.3 - Legal guarantees
TIMMERMAN EXPERTISE is liable for the legal guarantees applicable to goods, digital content and digital services supplied to the Client.
In the event of a lack of conformity, the consumer Client may request that conformity be restored under the statutory conditions and, where those conditions are met, a price reduction or termination of the contract. For tangible goods, the Client also benefits from the legal guarantee against hidden defects.
The statutory notices relating to legal guarantees, together with information adapted to the nature and duration of the supply, are included in the specific terms or durable medium provided for the order concerned where required by law.
The professional responsible for the guarantees is TIMMERMAN EXPERTISE. Any request may be sent to the contact details set out in Article 2.
14.1 - Recordings required for the Contest
Photographs, videos and audio recordings required for the conduct of the session, creation of the comp card, assessment of the Participant and retention of the information enabling the jury to make its decisions are produced as part of the performance of registration and the Contest.
They may be viewed by authorized members of the OPEN CALL team, the jury and associated professionals to the extent necessary for organizing and assessing the Contest.
14.2 - Intellectual property and rights granted to the Participant
Trademarks, logos, texts, graphic identities, websites, videos, photographs, comp cards and other creations remain the property of their authors or rights holders. The Client and the Participant receive only the rights expressly granted.
The Participant may use the delivered comp card for the Participant’s portfolio, applications, professional presentation and own social media accounts.
Unless otherwise authorized in writing, resale, granting advertising rights to a third party, misleading removal of a signature, alteration that infringes the author’s moral rights, or any use suggesting a nonexistent approval or partnership is prohibited.
Rights relating to photographs, videos or other items purchased separately are specified at the time of the order.
Raw files, footage, unselected photographs and working files are not delivered, unless otherwise agreed in writing.
TIMMERMAN EXPERTISE processes the data required to manage applications, contracts, payments, invitations, sessions, comp cards, assessments, OPEN CALL REVIEW events, results, prizes, customer service, complaints and legal obligations.
The data may include identity, age, contact details, measurements, photographs, videos, voice and, where strictly necessary, identity documents or documents relating to minors.
Certain profile elements may be presented to authorized team members, necessary service providers, the jury, agencies, brands and associated professionals to the extent required for the Contest. Any transfer for an opportunity outside the Contest that is not necessary for its conduct is based on specific information and, where required, the Participant’s consent.
Data are retained during the season and then, depending on their nature, for the period required to follow the relationship, establish rights, manage complaints and comply with legal obligations. Accounting documents are retained for ten years; prospecting data for no more than three years from the last contact; and promotional content for the duration of the separate authorization, without exceeding five years of use. Sensitive supporting documents are deleted as soon as they are no longer necessary, unless there is a legal obligation to retain them.
Under the conditions provided by regulations, every data subject has rights of access, rectification, erasure, restriction, objection and, where the conditions are met, portability. The data subject may also withdraw consent for processing based on consent, without affecting the lawfulness of earlier processing.
These rights may be exercised by writing to contact@open-call.com. The data subject may also lodge a complaint with the French Data Protection Authority (Commission nationale de l’informatique et des libertés - CNIL).
Detailed information on legal bases, recipients, any transfers and the arrangements for exercising rights is set out in OPEN CALL’s privacy policy.
Communications strictly necessary to process an application, order, session or contract do not constitute commercial prospecting. Promotional communications are sent in compliance with the applicable rules and required consents.
The Organizer is responsible for the proper performance of its obligations in accordance with the applicable rules. No provision of these T&Cs limits its liability in the event of personal injury, gross negligence, willful misconduct, breach of an essential obligation or in any other case where the law prohibits a limitation.
The Organizer is not liable for damage caused exclusively by the Client or the Participant, by a third party meeting the conditions required by law, or by a force majeure event.
OPEN CALL does not guarantee any employment, contract, casting, representation, assignment, income, publication, audience, recognition or professional career, subject to the prizes expressly provided for by the Rules.
Offers made by third-party agencies, brands or professionals are their own. TIMMERMAN EXPERTISE is not a party to any contracts entered into between those third parties and the Participant, unless otherwise agreed in writing.
The Participant remains responsible for personal belongings, travel, compliance with instructions and communicating any health or safety constraint strictly necessary for participation. This provision does not release the Organizer from its own safety and vigilance obligations.
Loss, theft or damage to a personal item gives rise to the Organizer’s liability only where it results from a fault attributable to the Organizer.
18.1 - Prior complaint
Any complaint must first be sent by email to contact@open-call.com.
It must state the Client’s and Participant’s names, their contact details, the date and location of the session, the precise subject of the request and any useful supporting documents. The Organizer responds within a reasonable period.
These T&Cs are governed by French law. This choice does not deprive a consumer habitually resident in another State of any more protective mandatory provisions that may apply to that consumer.
The parties first seek an amicable solution. If no amicable solution or mediation is reached, the dispute is brought before the competent court in accordance with the ordinary rules applicable to consumers. No clause requires the consumer to bring proceedings before a court that lacks territorial jurisdiction.
The Organizer may amend these T&Cs for the future. The version applicable to a registration or order is the version accepted on the date of payment, unless a new legal provision applies immediately or the amendment is exclusively favorable to the Client.
A subsequent amendment does not apply retroactively to rights already acquired.
If a provision is declared null, invalid or unenforceable, the other provisions remain in force insofar as the overall balance of the contract can be maintained.
Failure to invoke a provision immediately does not constitute a permanent waiver of the right to invoke it later.
These T&Cs supplement the official rules of the OPEN CALL contest - Season 2.
The T&Cs prevail for matters relating to formation of the contract, price, payment, withdrawal, cancellations, postponements, refunds, delivery, conformity, legal guarantees, contractual liability, complaints and mediation.
The Rules prevail for the artistic conduct of the Contest, categories, OPEN CALL REVIEW events, the jury, assessment criteria, designation of the winner and prizes.
Specific terms accepted for an additional order specify the features and rules applicable to that order. They prevail over these T&Cs only for those specific elements.
The privacy policy specifies the processing of personal data.
Mandatory legal provisions always prevail over the contractual documents.
